1. Acceptance of Terms

By creating an account on FurHomie, accessing, browsing, or using any features of the FurHomie platform (the "Platform"), you ("User," "you," or "your") agree to be bound by these Terms & Conditions ("Terms"), our Privacy Policy, and all applicable laws. If you do not agree, you must not use the Platform. These Terms constitute a legally binding agreement between you and FurHomie, operated by Pawsitivity, LLC.

2. Eligibility

You must be at least 18 years of age to create an account and use the Platform. By registering, you represent and warrant that:

You are at least 18 years old
You have the legal capacity to enter into these Terms
You are not prohibited from using the Platform under applicable law
All information you provide is accurate and complete

3. Account Registration

To access most features of the Platform, you must create an account. You agree to:

Provide accurate, current, and complete registration information
Maintain and update your account information to keep it accurate
Maintain the security of your account credentials
Accept responsibility for all activity under your account
Notify FurHomie immediately of any unauthorized use

FurHomie reserves the right to suspend or terminate accounts that contain false information or violate these Terms.

4. User Responsibilities

You are solely responsible for:

All content you post, upload, or share on the Platform
Your interactions with other users
Any events or activities you create, host, or attend
Your conduct on and off the Platform in connection with FurHomie activities
Compliance with all applicable local, state, and federal laws
Any harm caused to persons, animals, or property

5. Dog Ownership Responsibilities

As a dog owner using FurHomie, you represent, warrant, and agree that:

You are the legal owner or authorized handler of any dog associated with your profile
Your dog is current on all required vaccinations and licensing
You will accurately represent your dog's breed, size, temperament, and behavioral history
You will disclose known aggressive tendencies or behavioral issues
You will supervise your dog at all times during playdates and events
You will comply with all applicable leash laws and local ordinances
You assume full liability for your dog's behavior and any harm it causes
You carry appropriate liability coverage for your dog where required

6. Community Guidelines

FurHomie is a community platform built on respect, safety, and honesty. You agree to treat all users, animals, and locations with care. Violating community guidelines may result in suspension or permanent removal. See our full Community Guidelines for details.

7. User-Generated Content

You retain ownership of content you upload to FurHomie, including photos, videos, posts, and comments ("User Content"). By uploading or posting User Content, you grant FurHomie a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, display, distribute, modify, and promote your User Content solely in connection with operating and improving the Platform.

You represent and warrant that you own or have all necessary rights to the content you post, and that your content does not infringe any third-party rights.

FurHomie reserves the right to remove any User Content that violates these Terms, is illegal, abusive, dangerous, or creates legal risk for the Platform or its users, without prior notice.

8. Intellectual Property

The FurHomie name, logo, platform design, software, and all proprietary content created by FurHomie are the exclusive property of Pawsitivity, LLC and are protected by applicable intellectual property laws. You may not reproduce, copy, distribute, or create derivative works without express written consent.

9. Messaging and Communications

FurHomie may provide in-app messaging features. You agree not to use messaging to harass, threaten, spam, solicit, or engage in any prohibited conduct. FurHomie may monitor communications for safety and legal compliance purposes. Do not share personal contact information until you are comfortable doing so with another user.

10. Event Creation and Participation

FurHomie is solely a technology platform. FurHomie does not organize, host, supervise, staff, inspect, or coordinate any events, playdates, meetups, or gatherings listed on the Platform. All events are independently created, organized, and managed by individual users.

Event hosts are not employees, agents, contractors, partners, joint venturers, or representatives of FurHomie in any capacity. FurHomie has no control over and makes no representations regarding the safety, quality, legality, or suitability of any event.

By creating or RSVP'ing to any event on FurHomie, you acknowledge that participation is entirely voluntary and at your own risk.

11. Safety Disclaimer

FurHomie does not:

Verify the identity, background, or credentials of any user
Verify vaccination records, licensing, or health status of any dog
Inspect or assess any event venue for safety
Supervise or monitor any playdate, meetup, or gathering
Guarantee the conduct of any user, host, or attendee
Guarantee the temperament or behavior of any dog
Provide insurance, veterinary services, or emergency assistance

You are solely responsible for your own safety, the safety of your dog, and any guests or animals in your care during any event organized through FurHomie.

12. Assumption of Risk

BY USING THE FURHOMIE PLATFORM AND PARTICIPATING IN ANY DOG PLAYDATE, MEETUP, GATHERING, EVENT, OR ACTIVITY ORGANIZED THROUGH FURHOMIE, YOU EXPRESSLY ACKNOWLEDGE, UNDERSTAND, AND AGREE THAT:

Dog-to-dog and dog-to-human interactions carry inherent risk of injury, illness, and death
Participation in any event is entirely voluntary and at your own risk
You assume all risk of dog bites, injuries, illness, property damage, disputes, and any other harm
You are responsible for assessing whether any event or interaction is appropriate for your dog
FurHomie has no duty to protect you from these risks

You voluntarily and knowingly accept these risks as a condition of using the Platform.

13. Veterinary and Health Disclaimer

FurHomie does not provide veterinary, medical, behavioral, training, or professional advice of any kind. No content on the Platform, whether posted by FurHomie or other users, constitutes professional advice. Always consult a licensed veterinarian for health or behavioral concerns about your pet. FurHomie is not responsible for any health outcomes resulting from reliance on Platform content.

14. Prohibited Conduct

You agree not to:

Harass, threaten, bully, or intimidate any user or animal
Post hate speech, discriminatory content, or slurs
Falsify your identity, your dog's information, or vaccination status
Engage in fraud, scamming, or deceptive practices
Spam other users with unsolicited messages or promotions
Impersonate another person, business, or organization
Upload or share illegal content, including unlicensed copyrighted material
Engage in or promote any illegal activity
Sell dogs, pets, services, or products through the Platform
Bring an unvaccinated or unsafe dog to any event without disclosure
Attempt to circumvent safety measures or Terms enforcement
Scrape, harvest, or collect user data without authorization

15. Reporting and Moderation

FurHomie provides reporting tools for users to flag unsafe behavior, content violations, or concerns. FurHomie will review reports and take appropriate action at its sole discretion. FurHomie is not obligated to monitor all content or resolve all disputes, but may do so when safety or legal compliance requires it. All reports are handled confidentially.

16. Suspension and Termination

FurHomie may, at its sole discretion and with or without prior notice:

Suspend or restrict your account
Remove any content, event, or listing
Permanently ban you from the Platform

Grounds for action include, but are not limited to: violation of these Terms, safety concerns, legal compliance, platform integrity, or protection of other users. You may delete your account at any time through your account settings.

17. Third-Party Services

The Platform may contain links to third-party websites or services. FurHomie does not endorse, control, or assume any responsibility for third-party content, products, or services. Your use of third-party services is governed by their respective terms and policies.

18. Disclaimer of Warranties

THE FURHOMIE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. FURHOMIE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES. YOUR USE OF THE PLATFORM IS ENTIRELY AT YOUR OWN RISK.

19. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FURHOMIE, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

Dog bites, animal attacks, or animal-related injuries
Personal injury or death
Property damage or loss
Veterinary expenses or medical expenses
Emotional distress
Lost profits or revenue
User disputes or criminal acts
Event cancellations or no-shows
Conduct of hosts or attendees
Reliance on user-generated content

IN NO EVENT SHALL FURHOMIE'S TOTAL LIABILITY EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID FURHOMIE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

20. Indemnification

You agree to indemnify, defend, and hold harmless FurHomie, Pawsitivity LLC, and their respective owners, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Platform; (b) your User Content; (c) your participation in any event; (d) your dog's conduct; (e) your violation of these Terms; or (f) your violation of any applicable law or third-party rights.

21. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Pawsitivity, LLC is incorporated, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration.

22. Changes to Terms

FurHomie reserves the right to update or modify these Terms at any time. When material changes are made, we will notify you by posting the updated Terms on the Platform and, where required by law, requesting your re-acceptance before continued use. Continued use of the Platform following notice of changes constitutes acceptance of the revised Terms.
